Terms of sale

How it works, said up front.

What applies when you buy a vehicle from us: prices, availability, warranty, payment. Whatever depends on the individual agreement we discuss during the negotiation and put in the contract, not here.

This is an English translation provided for convenience. The legally binding text is the Italian version, and Italian law applies.

In short. This website is a showroom: you can't buy online. No contract is concluded here and no payment goes through these pages. You see the vehicle in Piacenza and the sale takes place at our premises.

The prices shown are the asking prices on the date of publication. Availability must be confirmed: a car may be sold before the page is updated.

The vehicles are used and sold as they are, but they are always handed over with the interior cleaned and sanitised and freshly serviced. If you buy as a private individual you have the twelve-month legal warranty, and we remain available afterwards too.

1. Who the seller is

DP Automotive & D.C. Auto is a shared trading name used by two separate sole proprietorships, not a single company:

For each vehicle, one of the two is the seller, and which one is stated in the contract and on the invoice. If this matters to you — for invoicing, for the warranty, for registration — ask before signing: we'll be happy to tell you.

2. The website is a showroom, not a shop

This website shows the vehicles available and our contact details. It is not an online shop: it has no basket, does not accept orders, does not receive payments and does not conclude contracts. The forms prepare a message that you open in WhatsApp or in your email, and you are the one who sends it; the copy of the request that reaches our management system is used to reply to you, is not an order and commits neither you nor us.

The information published is an invitation to contact us, not a contractual offer under Article 1336 of the Italian Civil Code. The sale is completed at our premises, when the documents are signed. The written contract and the vehicle's documents take precedence over anything written on this website.

3. Prices

  • They are in euros and are the asking prices on the date the page was published. They may change without notice: the price confirmed during the negotiation is the one that counts.
  • They refer to the vehicle as it is, with the equipment described on its page.
  • They are final prices for private buyers: what you see is what you pay for the vehicle, with no taxes added afterwards. The only thing not included is any cost for the change of ownership, as described in the point below.
  • We sell used vehicles under the margin scheme (Article 36 of Italian Decree-Law 41/1995): VAT is not shown on the invoice and cannot be deducted, not even by buyers with a VAT number. This is the normal scheme for vehicles bought from private individuals. If a vehicle is an exception, we tell you beforehand, and in any case it is shown on the invoice.
  • Whether the change of ownership is included in the price or paid separately we tell you during the negotiation, and it is written in the contract. When the website says we handle the change of ownership, it means we take care of the paperwork: it is not in itself a statement about who pays the costs.
  • An obvious error in the price — a wrong figure, an extra zero — does not oblige us to sell at that figure. If it happens we say so straight away, and you are free not to go ahead.

4. Availability

Every vehicle is one of a kind: once it is sold, there isn't an identical second one in stock. The pages are updated by hand, so there may be a gap between what you see and what is actually there. Availability is only confirmed by us, by phone, WhatsApp or email.

A vehicle can be put aside: if we do so, the duration and conditions — including whether you leave a deposit and what happens to it if you don't go ahead — are put in writing. Without a written agreement, no reservation is binding on either party.

5. Descriptions and photos

  • Year, mileage, fuel, gearbox and equipment are taken from the vehicle's documents and from our listings. We take care over them, but a transcription error is possible: the vehicle's documents are what count, and you can see them before signing.
  • The photos show the actual vehicle. Some come from the portals where we list our vehicles and may carry their watermark; colours and details may look different from one screen to another.
  • These are used vehicles: they show wear consistent with their age and mileage, which is not a defect. What we know about the vehicle's condition we tell you, and whatever we find is declared in writing before signing.
  • It's a good idea to see it and try it. You can do so by appointment: it is the simplest way to avoid surprises, for you and for us.

6. Vehicles on consignment

Our services include consignment sales: we keep and show a vehicle on behalf of its owner. In that case the seller may be the owner and not us, and who the seller is will be told to you and put in writing before signing.

The twelve-month warranty still applies. When the seller is the private owner, the law does not impose it on them — a private individual is not liable in the same way as a business — and so we give you those twelve months ourselves, with the same content: it is a commercial warranty of ours, stated in the sale documents. For you nothing changes: twelve months from handover, and you call us.

You don't have to ask: vehicles on consignment are marked as such already in the showroom, with the words “On consignment” on the vehicle's page. You know before you come to see it, not when you are in front of the paper to sign.

7. Warranty

If you buy as a consumer, that is as a private individual

You have the legal guarantee of conformity provided for by the Italian Consumer Code (Articles 128 and following). For used goods the law allows the parties to reduce its duration, but not below twelve months (Article 133): on our vehicles twelve months from handover apply, which is also what we state on the listings.

The warranty covers lack of conformity, meaning a vehicle that does not match what was agreed or is not fit for use. You can ask for repair or replacement and, where these are not possible or do not solve the problem, a price reduction or termination of the contract.

The following are not lack of conformity, and are therefore excluded:

  • normal wear of consumable components, consistent with age and mileage;
  • defects declared in writing before the sale and accepted, which by law do not give rise to a warranty claim precisely because you knew about them;
  • damage from improper use, accidents, lack of routine maintenance or work carried out incorrectly by third parties;
  • use in motorsport competitions.

A defect must be reported as soon as you discover it, to the contact details in section 12: the sooner you tell us, the less it risks getting worse and the easier it is to show it was already there at handover.

If the vehicle is on consignment

The twelve months apply all the same, on every vehicle in the showroom. If the seller is the private owner (section 6), that is not the legal warranty, because the law does not impose it on a private individual: it is a warranty we provide ourselves, with the same duration and content described above, written in the sale documents. We are the people you deal with in both cases.

If you buy as a business or with a VAT number

The Consumer Code does not apply: the Italian Civil Code rules on sales apply (Articles 1490 and following), with their own notification and limitation periods, and whatever is agreed in the contract.

Further warranties

If there is a manufacturer's warranty still valid on the vehicle, or if a paid commercial warranty is offered, this is stated in the documents we give you, with its duration and coverage. No additional warranty reduces the legal one: it adds to it.

After the twelve months

The legal warranty lasts twelve months, but our policy is to remain available afterwards too: if a problem comes up, call us anyway. We'll look at the vehicle and tell you what can be done, whether in our workshop or by pointing you to the right people.

It is worth being precise about what this is: it is an after-sales commitment, the way we work, not a commercial warranty. It has no predefined coverage or free repairs set in advance, and it neither takes away nor adds anything to the rights the law gives you during the twelve months.

8. Right of withdrawal

The fourteen-day right of withdrawal does not apply, and it is worth explaining why rather than just saying so: that right concerns contracts concluded at a distance or off business premises. Here the contract is signed at our premises, after the vehicle has been seen: it is an in-store sale, and for those the law does not provide a cooling-off period.

If, however, a purchase were ever concluded without you coming to our premises — negotiation and signing entirely at a distance — then that right would be yours, and in that case we would first give you the information and the withdrawal form required by law.

9. Payment

  • The accepted forms of payment, any deposits and the due dates are agreed and put in writing before signing.
  • Cash is accepted only within the limits set by Italian law for cash payments; above that threshold a traceable means of payment is required.
  • The website says that you can pay in instalments. The amount, number of instalments, due dates and — if payment in instalments goes through a loan — the identity of the intermediary and all the financial terms are given to you in writing and in advance of any signature. No figure published on the website is a credit offer.
  • The vehicle is handed over and registered once payment is complete, unless otherwise agreed in writing.

10. Change of ownership and handover

We take care of the change of ownership: we collect the documents and follow the paperwork. A valid identity document, an Italian tax code and, for registration, the details required by law are needed; without them the paperwork cannot be done.

The timing depends on the public offices and not only on us: we tell you the expected times and let you know if they change. Handover takes place at our premises, in Piacenza on Strada Valnure, at the Q8 petrol station; collection and delivery elsewhere can be arranged.

The condition we hand it over in

Every vehicle is handed over washed inside and out, with the interior sanitised and serviced. These are included in the price: they are not extra services to ask for and are not charged. If a vehicle is an exception — because it is sold as it is, or because it has just been serviced by someone else — we tell you beforehand and it is stated in the documents.

11. Part-exchange and selling us your vehicle

Your vehicle is valued, whether for part-exchange or for an outright purchase, by seeing it. A figure given over the phone or on WhatsApp based on what you tell us is an indication, not a commitment: the final valuation is the one made in person, and it is valid for the time we tell you.

The seller must be entitled to dispose of the vehicle: ownership or a valid authorisation is required, together with the vehicle's documents and a correct declaration of any seizures, liens or outstanding finance. We rely on what you declare when setting the price.

For a formal complaint, certified email (PEC) is the channel that provides a legally certain date. We reply as quickly as possible.

13. Applicable law and disputes

Italian law applies.

If you are a consumer, the competent court is the one of the place where you live or are domiciled: this is a protection the law gives you and that no clause can take away, including these terms.

Before going to court, conciliation can be attempted, for example at the competent Chamber of Commerce or at a mediation body accredited by the Italian Ministry of Justice. It is quicker and cheaper for both parties.
